Aims

The cours aims to deepen the general course of private international law. Rather than adopting a global approach of theoretical concepts, it focuses on the analysis of practical problems based on the study of specific issues. Doing so, it encourages a critical approach of the law as it is, among others in view of possible legislative improvements.

Main themes

The issues vary from one year to the other. They all concern the influence of European law on private international law. Alternatively, they deal with fundamental rights, in particular the European Convention on Human Rights, and with the law of the European Union, in relation to the condition of foreigners, conflits of jurisdictions and conflicts of laws.

Content and teaching methods

Students may be requested to prepare lectures by reading some materials, in particular case law.

The book of F. Rigaux & M. Fallon, Droit international privé, Brussels, Larcier, 2005, serves also as a basis.

The examination is oral. The student prepares the answer to a written question by using any documents of his choice.
