After the ratification of the Geneva Convention, EU Member States have developed refugee protection systems purportedly compliant with their international obligations. However, when dealing with entry rights, traditionally viewed as sovereignty prerogatives, they have mostly considered refugees as foreigners, disregarding their entitlement ‘to special protection on account of their position’. Prior to their admission, Member States have assimilated refugees to the broader class of non-citizens, distinguishing them from other migrants only once they are deemed to have technically reached national territory. The question of physical access to protection is thus left to general immigration regimes, increasingly focused on the fight against illegal immigration.

To the proliferation of policies of non-entrée, there joins the increasingly popular practice of remote border control. Inconsistently, States maintain a notion of strictly territorial jurisdiction as for their human rights obligations vis-à-vis refugees, whereas they exercise an extraterritorial surveillance of their administrative frontiers. However, the too facile link between State jurisdiction and the limits of its territory, as designating the only ambit where it exercises its sovereignty, has been contested in Human Rights circles. The accent is gradually being put on the actual influence of State action, be it intra- or extraterritorial, to determine the scope of its correlate obligations.

This is the lens through which EU immigration control measures, directly impacting on refugees’ effective access to international protection, are scrutinized in this PhD project, the premise being that ‘Member States (are) to establish effective protection-sensitive entry management systems’ (cf. European Commission Green Paper on Asylum).

This thesis will study the non-judicial mechanisms set up by States to gradually achieve the full realisation of human rights.

The first part of the thesis will analyse the international legal context and the functions of non-judicial mechanisms for the implementation of international human rights. The second, third, fourth and fifth parts of the thesis will examine the institutions and tools that states are required to put in place with a view to ensuring better compliance with existing international human rights instruments.

The following mechanisms will be discussed: national institutions for the promotion and protection of human rights, human rights indicators and benchmarks, human rights impact assessments, and national human rights plans of action. The procedural dilemmas of the implementation of international human rights including the participation of actors and the sharing of best practices will be analysed throughout the thesis. The thesis will be written in English and its territorial area of application be limited to the Council of Europe.

This thesis will study the impact that structural adjustment and equivalent policies have on the enjoyment and fulfillment of human rights. Research work will focus on the instances of non-compliance with human rights obligations (particularly those relating to economic, social and cultural rights) and the problem of attribution of responsibility to the multiple actors involved: states requesting funds, international financial institutions establishing the terms under which funds are made available, and States with decision-making power within these institutions. This tripartite division of actors will require an extensive analysis of the different sources, content and extent of obligations applicable to each actor under international human rights law. The extent to which each of these subjects are required to act in order uphold their human rights obligations in the context of structural adjustment, engenders a specific regime of responsibility that will be critically assessed using the general rules of international responsibility, as expressed in customary law, and other sources such as the articles on the responsibility of states, and the current works of the International Law Commission on the international responsibility of international organizations. Finally, an evaluation will be carried out regarding the mechanisms of enforcement and promotion of the fundamental rights possibly affected by structural adjustment policies.

La thèse interroge les origines de la persitance de la discrimination dans la relation de l'emploi et le marché du travail, par une intégration des enseignements des disciplines voisines du droit, pour constater que la liberté contractuelle de l'employeur est à la sources de l'inefficacité partielle des normes anti-discriminatoires. En privilégiant la distribution du travail en fonction des mérites ou des qualifications des candidats, les normes interdisant la discrimination dans le travail ambitionnent de garantir simultanément les trois finalités que sont la justice interindividuelle, la participation égale des groupes identifiés et la poursuite de l'efficience économique. La persitance d'une discrimination polymorphe et systémique dans l'emploi sanctionne toutefois l' "inadaptation" des législations politiques publiques actuellement en vigueur.

Une analyse juridique comparée (particulièrement des concepts juridiques centraux évoqués précédemment) entre les Etats-Unis, le Canada et le système européen sélectionnés tout à la fois pour la diversité des approches du phénomène discriminatoire qu'ils illustrent, des modèles qu'ils caractérisent et pour l'originalité des politiques publiques adoptées - est conduite simultanément à l'approche économique des phénomènes discriminatoires. Si diverse théories économiques dévoilent la rationalité économique de certains comportements discriminatoires en ce qu'ils sont considérés par les employeurs comme liés à une finalité productive (et donc à la rentabilité de la firme) et ipso facto "jugés légitimes" à pratiquer pour demeurer compétitif dans un marché concurrentiel (G. Becker, E. Phelps, G. Akerlof), il nous appartiendra alors de créer les conditions pour dissuader les agents économiques de discriminer en les incitant à réfléchir leurs pratiques d'évaluation de la qualité des (candidats) travailleurs.

C'est pourquoi la thèse réserve à l'interdiction de la discrimination indirecte, à l'obligation d'organiser des aménagements raisonnables et à l'introduction d'actions positives à l'embauche, une attention particulière en ce qu'ils introduisent notamment une exigence porteuse de réflexivité au sein de l'entreprise en contraignant les employeurs à analyser l'effet collectif de leurs méthodes d'évaluation. Dans le prolongement, la thèse identifie les signes d'une évolution de la reconnaissance d'une "liberté de travailler" vers une consécration d' "un droit au travai"l, à l'appui d'une réflexion sur la nécessité de renforcer l'encadrement juridique de la relation d'emploi.

L'état actuel du mécanisme de contrôle du deuxième Pacte de 1966 qui consacre ces droits ne permet pas le contrôle des situations individuelles. En effet, il n'est reconnu à ce Comité qu'un pouvoir de vérifications générales (articles 16 et 17). L'hypothèse sur laquelle nous travaillons consiste à dire qu'il y a possibilité de créer, par l'adoption d'un Protocole additionnel, le droit de saisine individuelle pour permettre aux individus, groupes d'individus, ong, syndicats, etc. de faire vérifier, par ce biais, la mise en oeuvre des obligations étatiques en ce qui regarde sa mise en oeuvre. Un projet de Protocole de ce genre fait l'objet de débats dans les organes de l'O.N.U. depuis quelques années. Il a paru important d' y contribuer à travers cette réflexion.

Diversité culturelle et droits fondamentaux. La jurisprudence de la Cour européenne des droits de l'homme Cette recherche a pour objet la question de la diversité culturelle dans la jurisprudence de la Cour européenne des droits de l'homme. Elle part du constat que, bien que la Convention européenne des droits de l'homme ne contienne pas de disposition protégeant les "identités culturelles", la Cour est régulièrement confrontée à des arguments fondés sur une exigence de respect des différences culturelles, émanant tantôt des requérants, tantôt des Etats mis en cause. L'étude s'appuie sur une analyse critique des décisions de la Cour à la lumière des réflexions menées dans le champ de la philosophie politique. Elle vise à démontrer qu'en dépit du caractère modeste de la contribution de la Cour au règlement des litiges à dimension culturelle, les droits et libertés protégés par la Convention, interprétés de façon dynamique, pourraient fournir les bases d'un système équitable d'accommodement de la diversité culturelle au sein des sociétés européennes.

Debates about justice are confined besides or above the immanence of biotechnological innovations and 'truths' soon conceived as constitutive of our new 'state of nature', and besides or above the sphere of individual privacy that increasingly encompasses voluntary trade-offs consented to by individuals in order for them to make the most of those of their 'natural' skills, talents and strenghts that are most valuable in the dominant cooperative framework they find themselves in. As a result from the dialectical relationship of biotechnology and the market, the 'Norm', grounding the algorithms used to sort people according to criteria (such as 'need' or 'merit') that determine eligibility for benefits, rewards or opportunities result more from the sub-politics of biotechnology and markets than from democratic debates. The most overwhelming and probably the least conceivable challenge for the law on the threshold of the genetic era consists in reinventing its own metabolism against a complex background deserted by most previous cultural evidences, including the traditional oppositions made between categories of subject and object, chance and choice, private and public, freedom and determinism, health and disease, natural and artificial...Behind issues of fairness and justice, at stake is the definition of a concept of the self either as 'autobiographical animal' (Jacques Derrida)or as rational administrator of its 'human capital' (Michel Foucault) constituted by genetic talents and acquired skills, a being completely absorbed in its own context (the hegelian 'Dasein'). This thesis attempts to elucidate the relationship existing between access, disclosure and use of human genetic information and our conceptions of both individual autonomy as individual rights embedded in the context and/or as political empowerment enabling the transformation of the dominant cooperative framework.
