Aims

The objective of the course is to teach the student the concepts of Community and European Union law. Emphasis is put on the analysis of the principles founding the community juridical order as an autonomous juridical order, on presenting the mechanisms that rule the functioning of the institutions and the production of legislative instruments, and on the rules organising legal disputes. The course also aims at introducing material law concepts, by presenting the objectives of the Union.

Main themes

The course has the following contents:

1. Object of Community and European union law: sources (history of integration, presentation of the founding treaties), institutional (law of organisations: nature, capacity, seat, funding) and material (objectives of the integration, establishment of the internal market and implementation of policies) objects.
2. Institutions: composition and powers: description of the different agencies, analysis of their normative roles as well as procedures of adoption of acts
3. Legislative acts: analysis of the various types of instruments that the Community and the Union can adopt; determination of their nature and their scope
4. Community disputes: analysis of the various competences given the community jurisdictions, and more generally sanctions, for example towards private persons or third states.
