Aims
It includes an introduction to legal aspects of insurance, particularly with regard to contract law in insurance.
Main themes
Following an introduction which should, in particular, include brief background information, the course covers aspects of the economic and social role of insurance, information on regulations concerning the auditing of insurance companies, and European law. It also systematically examines procedures relating to different regulations applicable to insurance contracts: regulations concerning all contracts and those specific to insurance covering compensation and lump-sum indemnities, damages (property and liabilities) as well as personal injury.
Content and teaching methods
METHODS:
The course is mainly in the form of lectures. The lectures regularly refer to contract documents used in practice which are included in the written reference material. The course has two main types of reference material: a summary of insurance law (Larcier, 2nd edition, 1996), available at a reduced price for students, and a collection of texts, policies and documents.
CONTENTS:
After an introduction relating to the techniques, economics and auditing of insurance procedures, the course systematically examines the law of 25 June 1992 on land insurance contracts. It is followed by: regulations covering all types of land insurance; specific regulations concerning compensation and lump-sum indemnities; specific regulations concerning damages and personal injury insurance; specific regulations covering property, expenses and third-party liabilities. Depending on the time available, three particular areas are examined: fire insurance, third-party vehicle insurance and life insurance.
Other information (prerequisite, evaluation (assessment methods), course materials recommended readings, ...)
In order to be able to adequately follow the course, the student must show that he/she has already mastered the basic principles of the law of contract.
