The course covers the institutional and material law of the WTO: the history of the GATT and the institutionalization of the WTO, the dispute settlement procedure, the basic rules (including the exemptions, etc.) of the exchange of goods (GATT) and services (GATS). The study of the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS) is however not detailed. The emphasis is placed on the 'case-law' of the Dispute Settlement Body.
The purpose of this course is to present in a comprehensive and coherent way the two legal foundations of the economic globalization: the law of the World Trade Organization (WTO) and the law of foreign direct investments. The aim is to analyze thoroughly how the legal technique of public international law is used to promote international trade (WTO) and to protect an essential factor of production (investment) moving according to the liberal rule of comparative advantages. The objective is also to study the relationship between those rules and other rules of international law, including those protecting the environment and the fundamental rights of individuals.
