The purpose of this course is to present in a comprehensive and coherent way the law that governs the international relations of the European Community (EC) and the European Union (EU). The aim is to thoroughly analyze how the Community and the Union fit in a broader set of international relations governed by the rule of law, and in turn see how international law enters the European legal order.
This course is part of a coherent cluster. The different professors in charge of a course in the framework of this cluster consult each other on the content and the methods of each course in order to ensure complementarity.
As far as possible and given the number of students enrolled, the course is based on participatory teaching methods. The professor illustrates its course with examples and invites the students to apply the newly acquired knowledge to practical situations.
Main themes
The course is divided into two parts. The first part focuses on some basic notions such as the personality of the EC and the EU, the external competences (treaty-making power), the treaty-making process, the relations between international law and EC law, from the point of view of the Community legal order.
The second part is devoted to the study of the legal aspects of the Common Foreign and Security Policy (CFSP) of the Union. Some EC policies which have an important international character will also be analyzed, such as the common commercial policy, the association policy and the cooperation policy.
