For the part of Mathias El Berhoumi: This course forms the second part of a constitutional law course that started in the first year (cfr document: Objectives and methods of the constitutional law I course). Ideally, at the end of Constitutional Law II, the student should be able to, essentially a) understand and assimilate the meaning(s) of the new legal concepts taught b) demonstrate rigour and precision in defining these concepts c) understand the links between these concepts; d) understand and assimilate the rules of positive law taught, placing them in their historical and political context e) read and understand the case law presented in the course f) handle the code containing the texts of positive law commented on in the course, identifying the relevant provisions and linking them to the rules deduced from them g) provide some elements of political explanation and critical evaluation of the legal systems studied, without confusing the registers of legal description and prescription, legal explanation, political explanation and ethical evaluation h) to analyse the political news reported in the daily press in the light of the concepts and rules studied. For the part of Luc Detroux: The main objective of the course is to introduce political science students to legal reasoning. Law, and more particularly public law, is in constant and rapid evolution. It is therefore preferable to focus on the method (mastery of principles, coherence of intellectual approach), which will remain, rather than on the subject matter, which will pass. At the end of the course, the student should be able to draft a legal reasoning based on a given situation, using the material he/she will have handled throughout the course (code, case law, etc.). A related objective is to invite the student to take an interest in current events in public law. The course thus aims to provide the student with the essential keys to debate public affairs with other citizens, whether or not they are lawyers. |
