Learning outcomes

At the end of this learning unit, the student is able to :

1 The course aims to complete the students' basic education in the Law of Obligations and in Contract Law as some major topics in these fields were only outlined during the second year of bachelor of law. The course will first focus on the links between, on the one hand, the general part of the Law of Obligations and, on the other hand, contemporary legislations pertaining to, for instance, the protection of the weak contracting party. Synergies between the general part of the Law of Obligations and specific contracts will be discussed as well. In addition, attention will be paid to the impact of new information and communication technologies on the formation of contracts and the evidence of legal transactions. The course deepens the knowledge of some basic constructions of the Law of Obligations, in particular those involving a plurality of parties as, for instance, the stipulation in favour of a third party, the substitution of rights, the transfer of obligations, .... The study of the aforementioned topics will be based on documents coming from the practice and the case law. There will be a strong focus not only on Belgian Law but also on the recent international instruments, as, to begin with, the Principles of European Contract Law (recent attempt to restate a European Contract Law).
