Main themes The first part of the course will be devoted to contract negotiation and more specifically intellectual property contracts. Thereafter and, in turn, the course will cover contracts for: - Research and development in the context of cooperation between companies or "classical" sub-contracting arrangements; - The assignment of intellectual property rights (patents, trademarks, copyright, etc.); - The granting of licences, (for patents, know-how, trademarks, copyright, etc.); - Technology transfer. The student's attention will be drawn to the significance of the general financial implications of the contract and to the financial impact of the legal provisions and also the role, sometimes crucial, that some of these clauses may play. Particular emphasis will be given to international contracts. The course has an interdisciplinary approach, not only towards economics but also other branches of law, e.g. tax law.
Aims To equip students for the negotiation, drafting and analysis of intellectual property contracts. In particular, students choosing this course should be capable of: - mastering the specific legislation on contracts dealing with aspects of intellectual property; - understanding and knowing how to apply the negotiation strategy for such contracts; - understanding the implications of the principal clauses encountered in this type of contract; - knowing how to correctly draft a contract relating to intellectual property. In practice, intellectual property rights give rise to very many types of contracts with numerous specific features. Thus, those students wishing to further their understanding of intellectual property can have the opportunity to improve their knowledge and understanding of these specific features. This course is part of a cohesive option which comprises three courses. The lecturers for the courses in this option are a team; they cooperate on the content and methods for each course to ensure that they are complementary. The course makes use of participatory teaching methods. (learning through projects or problems, comments on case-law or doctrines, debates with invited teachers, hands-on studies) to enable the student to make their own critical, searching and inventive observations. The student is encouraged to take an active part in the course and to involve him/herself with this learning experience which has an individual as well as collective aspect. To this end, the lecturers within the Faculty cooperate on the various options within the teaching programme implemented.
